1. Acceptance of Terms

By accessing or using the MOBIAP website ("Site") and services, you agree to be bound by these Terms of Service. If you do not agree, do not use the Site or services.

2. Services Description

MOBIAP LLC provides custom software development, fintech platform development, and related technology consulting services. Specific scope, deliverables, and timelines are defined in separate Service Agreements executed between MOBIAP and its clients.

3. Intellectual Property

Unless otherwise specified in a separate Service Agreement:

  • MOBIAP retains all rights to its pre-existing intellectual property, tools, and methodologies
  • Client retains ownership of their content and data
  • Deliverables are licensed according to terms defined in the applicable Service Agreement

4. Limitation of Liability

To the maximum extent permitted by applicable law, MOBIAP LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of the Site or services.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.

6. Dispute Resolution

Any dispute arising from these Terms shall first be resolved through good-faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings held in Delaware.

7. Use of Site

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Site
  • Collect user information without consent

8. Termination

We reserve the right to suspend or terminate access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or MOBIAP.
